1. Acceptance of Terms
By creating an account or using Ganyu's services, you agree to comply with and be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations.
If you do not agree with any part of these terms, you may not use our services.
2. Description of Service
Ganyu is an online platform that connects clients with service providers (Waganyu) across various service categories in Malawi. We facilitate:
- Service discovery and booking
- Payment processing
- Communication between clients and providers
- Rating and review systems
- Dispute resolution
Important: Ganyu is a platform that connects users. We do not employ service providers, and we are not responsible for the actual services performed.
3. User Accounts
3.1 Account Creation
To use Ganyu, you must:
- Be at least 18 years old
- Provide accurate, complete, and current information
- Maintain and update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
3.2 Account Types
- Client Accounts: For booking and paying for services
- Provider Accounts: For offering services to clients
3.3 Account Termination
We reserve the right to suspend or terminate accounts that:
- Violate these Terms of Service
- Engage in fraudulent activity
- Receive multiple negative reports
- Are inactive for extended periods
4. For Clients
4.1 Booking Services
When booking a service, you agree to:
- Provide accurate booking information
- Pay the agreed-upon price
- Be available at the scheduled time
- Treat service providers with respect
- Follow cancellation policies
4.2 Payment
- Payments are processed securely through our payment partner
- You authorize us to charge your chosen payment method
- All prices are in Malawian Kwacha (MWK)
- Prices may vary based on service type, duration, and provider
4.3 Cancellations and Refunds
- Cancellations 24+ hours before service: Full refund
- Cancellations within 24 hours: May incur fees
- No-shows: No refund
- Refunds processed within 5-7 business days
5. For Service Providers
5.1 Provider Obligations
As a service provider, you agree to:
- Provide accurate information about your services
- Maintain professional standards
- Honor confirmed bookings
- Arrive on time and properly equipped
- Complete work as described
- Treat clients with respect
5.2 Provider Verification
All providers must complete verification including:
- Identity verification
- Skills assessment
- Background checks where applicable
- Agreement to platform standards
5.3 Earnings and Payouts
- Platform fee: 15% per transaction
- Earnings available after service completion
- Minimum payout: MWK 1,000
- Payouts processed within 1-3 business days
- You are responsible for any applicable taxes
5.4 Independent Contractor Status
Providers are independent contractors, not employees of Ganyu. You are responsible for your own taxes, insurance, and business expenses.
6. Prohibited Conduct
Users must not:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Post false, misleading, or fraudulent content
- Harass, abuse, or harm others
- Attempt to circumvent platform fees
- Share login credentials
- Scrape or copy platform content without permission
- Use automated systems to access the platform
- Interfere with platform operation
- Conduct transactions outside the platform
7. Intellectual Property
All content on Ganyu, including text, graphics, logos, and software, is owned by Ganyu or licensed to us and protected by intellectual property laws.
You may not:
- Copy, modify, or distribute our content without permission
- Use our trademarks without authorization
- Reverse engineer our software
8. Disclaimers and Limitations
8.1 Service Disclaimer
Ganyu provides the platform "as is" without warranties. We do not guarantee:
- Quality of services provided by independent contractors
- Availability of specific providers
- Uninterrupted platform access
- Error-free operation
8.2 Limitation of Liability
Ganyu is not liable for:
- Direct or indirect damages from platform use
- Actions or omissions of service providers or clients
- Loss of data, profits, or business opportunities
- Third-party content or services
Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
9. Dispute Resolution
For disputes between users, Ganyu may provide mediation services but is not obligated to resolve disputes. We encourage users to:
- Communicate directly to resolve issues
- Use our reporting system for serious concerns
- Seek legal counsel for unresolved disputes
Any disputes with Ganyu shall be governed by the laws of Malawi and resolved in Malawian courts.

11. Changes to Terms
We may update these Terms of Service from time to time. We will notify users of significant changes via email or platform notification. Continued use after changes constitutes acceptance of the new terms.
